Dear Ray,

      The issue is what constitutes "physical
abuse" of children.

      A harsh whipping such as I received at age
eight or so?  Several mid-level whippings?  An
outright brutal beating that leads to bruised organs
or broken bones?  Abject poverty, leading to
questionable or outright deprived nutrition?  Taking
pictures of cute kids in a bathtub?  Secondhand smoke
in a household (my mother, bless her soul, was a heavy
smoker)?  Putting a kid, a la Dostoevsky's famous
chapter in The Brothers Karamazov, in a water-closet?
Yelling at a kid until he upchucks his dinner?
Rubbing a kid's face in the vomit?  Sending a kid to
bed without dinner?  Rubbing a chili pepper on his lips?

     Or, on the other hand, causing major organ
injury or raping the kid or breaking several bones
or breaking a single bone on a single occasion or
knocking the kid flat with a closed fist (I saw that
happenind many times over the years at the
****t Authority Bus Terminal in NYC).

     So, how many social workers do we hire to take
away, oh say, 25 million children from their parents?

     Or do we create show trials of alleged physical
abuse (a la the McMartin day care case) and empower
the state to frighten people with the threat of crossing
the doorstep into their homes? r do we set up remote
cameras in every home to spy on all activities during
a given day?

     The traditional and correct understanding of law
and family is that the family is very largely free of
legal, as opposed to social, controls.  Snooping
social workers are the enemy, not the friend of
society.  The presumption of physical abuse has to be
pegged very high and physical abuse must be defined
exceedingly narrowly to nutritional levels leading to
death or forms of parental violence clearly resulting
in permanent injury of the child.

     "Resulting in" rather than "clearly leading to"?
That's right.

     The state must be precluded from our family
lives except in cases of felonies under the natural
law.  And, yes, that includes all of those instances
when some guy decks his kid in a bus station.
