Was this a UI situation ?

I got a dubious ruling last week in the following situation:

Matchpoints, dealer W, none vul:

North holds:

6
A K 10 6 3 2
J 4
10 6 4 3

pass     pass      3D       pass(very slow)
pass       ?

North bid 3H, and the director allowed the bid

I don't know of any player who would Pass this North hand first seat, any 
vulnerability, any form of scoring - *if* a bid was available to show a 
weak-two in hearts or weak-two in a major.   Once this hand was not
opened, 
it becomes impossible to determine what the logical alternatives are for 
**this** player in the given auction; he had already defied logic once in 
the auction.
